Syafii Anwar2To discuss the issue of pluralism sharia and the prospect of democracy in postSoeharto Indonesia is very challenging. Not only because this topic is quite relevant withthe future of Indonesia as a nation state but also instilling a big question about the direction this country is heading. However before developing further analysis one should realize the existing condition of Indonesia as a nationstate. Sociologically Indonesia is a plural society which comprises more than 17000 islands 400 ethnics as well as various customs religions and beliefs. Currently the total population of Indonesia is around 225 millions. From this total population Muslims are the majority of the Indonesian populace (87.5 per cent Muslims 7 percent Protestant 2.5 percent Catholic 1.5 percent Hinduism 0.5 percent Budhism and 1 percent other belief/animism). Despite majority of the Indonesian populace are Muslims it is obvious that Indonesia is not an Islamic state. Indonesias state ideology is not Islam but it is based on Pancasila (Five Principles). The first principle of Pancasila is Ketuhanan Yang Maha Esa (Belief in One Supreme God). In this regard Indonesias founding fathers agreed that Indonesia is neither a secular nor theocratic state.3The Indonesian constitution UndangUndang Dasar 1945 (The 1945 Constitution) is not to be based on sharia. History also shows that the agenda of imposing sharia within the stateconstitution has failed since Indonesian independence in 1945 and the subsequent years. Since its independence in 1945 Indonesia has experienced democracy albeit it has also plunged into authoriatarianism in some junctions of its bloody history.
